But recently, we’ve seen Massachusetts drivers and business owners run into an unexpected problem: they purchased a new vehicle only to discover there were questions about whether it could be registered.
The reason? Massachusetts’ Low Emission Vehicle (LEV) Program
Fortunately, Massachusetts has since issued guidance that resolves many of these registration issues for certain vehicles.
Here’s what the LEV Program is, why it affected vehicle registrations, and what you need to know if you’re buying a new car or commercial truck in Massachusetts.
What Is the Massachusetts Low Emission Vehicle (LEV) Program?
The Massachusetts Low Emission Vehicle (LEV) Program is a set of emissions regulations administered by the Massachusetts Department of Environmental Protection (MassDEP). Its goal is to reduce vehicle emissions by increasing the availability of lower-emission and zero-emission vehicles throughout the state.
The program includes two major regulations:
- Advanced Clean Cars II (ACC II) for passenger cars and light-duty trucks.
- Advanced Clean Trucks (ACT) for medium- and heavy-duty commercial vehicles.
These regulations primarily apply to vehicle manufacturers, requiring them to gradually increase the percentage of zero-emission vehicles they make available for sale in Massachusetts over time.
Why Did the LEV Program Affect Vehicle Registrations?
While the regulations are aimed at manufacturers, they created an unexpected challenge for some vehicle buyers.
As manufacturers worked to comply with the new requirements, some new vehicles—particularly commercial trucks—were delivered with a Manufacturer’s Certificate of Origin (CO) stating the vehicle was not intended for registration in Massachusetts or other states following California emissions standards.
That meant some buyers reached the Registry of Motor Vehicles (RMV) only to discover there were questions about whether their new vehicle could be registered.
Massachusetts Responded with Temporary Exemptions
Recognizing the disruption this created for consumers, dealerships, and businesses, MassDEP issued guidance providing flexibility for certain 2026 and 2027 model year vehicles. Enforcement Discretion for Advanced Clean Trucks Requirements
Passenger Cars and Light-Duty Trucks
For passenger vehicles and light-duty trucks, MassDEP announced it will exercise enforcement discretion for certain Advanced Clean Cars II requirements during the 2026 and 2027 model years.
Manufacturers that continue supplying gasoline-powered vehicles while meeting certain reporting and program requirements will not face enforcement action for those model years.
For most Massachusetts consumers, this means gasoline-powered cars, SUVs, and pickup trucks continue to be available for purchase.
Commercial Trucks
MassDEP also announced an important exemption affecting many commercial vehicles.
Model year 2026 and 2027 Class 2b through Class 8 commercial vehicles may now be registered in Massachusetts even if the Manufacturer’s Certificate of Origin states the vehicle is not intended for registration in Massachusetts.
This exemption applies to many work vehicles used by:
- Contractors
- Landscapers
- Electricians
- Plumbers
- Municipalities
- Delivery companies
- Fleet operators
It’s important to note that the current exemption does not extend to 2028 and newer model year commercial vehicles.
